The case revolves around whether Section 3 of the 14th Amendment applies to the former President because of his assault on Capitol Hill.
Section 3 of the amendment dictates that any member of Congress or officer of the US who engages in insurrection cannot hold a public office.
14th Amendment Never Used Before
The amendment, which was intact after the Civil War, has never been used to bar anyone from holding a public office before.
Donald Trump has already been indicted in a number of cases, but a negative outcome of the court’s decision will put an end to his presidential candidature.
